Introduction and scope
This Privacy Policy explains how KernWerk Capital LLP ("KernWerk Capital", "we", "us" or "our") collects, uses and protects personal information when you visit our marketing website at kernwerkcapital.com (the "Site") or contact us through it.
KernWerk Capital is a private equity firm. The Site is informational only: it describes who we are, the kinds of businesses we look for and how to reach us. The Site is not a securities offering, and nothing on it is investment advice. The closing note in section 14 sets out the full disclaimer.
This policy covers the public pages of the Site, including Home, Why India, Insights, Criteria, Team, Careers and Contact. It does not cover any third-party website that we link to. Section 12 explains how those links work.
By using the Site, you agree to this policy. If you do not agree, please do not use the Site or submit information through it.
Information we collect
We collect only the information we need to respond to you and to keep the Site working. We group it into four kinds.
2.1 Information you give us through the contact form
When you use the contact or intake form, we collect:
- your name;
- your email address;
- your company name;
- your message; and
- the structured fields you select, namely Sector, Revenue Range and Inquiry Type.
2.2 Information you give us through the careers form
When you use the careers form, we collect:
- your name;
- your email address; and
- your message, including the role you are interested in.
2.3 Analytics data
We use Plausible Analytics to understand how people use the Site. Plausible is privacy-first and cookieless. It records aggregate data, such as the pages viewed and the type of device used. It does not collect personal data, set tracking cookies or follow you across other websites. Section 6 gives more detail.
2.4 Server and content-delivery logs
As is true for most websites, our hosting and content-delivery provider keeps standard technical logs. These may include your internet protocol (IP) address, browser type, the pages you request and the date and time of each request. We use these logs to run the Site, keep it secure and diagnose faults.
We do not ask for, and we ask you not to send, sensitive personal information such as government identifiers, financial-account details or health information.
How we use your information
We use the information above to:
- reply to your inquiry and continue any conversation you start;
- review applications submitted through the careers form;
- operate, maintain and secure the Site;
- understand, in aggregate, how the Site is used so that we can improve it; and
- meet our legal and regulatory obligations.
We do not sell your personal information. We do not use it for advertising, and we do not track your behavior across other websites.
Legal bases for processing (GDPR)
If you are in the European Economic Area (EEA) or the United Kingdom, data-protection law requires us to have a legal basis for using your personal information. Our bases are:
- Consent. You consent when you choose to submit a form. You may withdraw consent at any time, as section 9 explains.
- Legitimate interests. We have a legitimate interest in responding to inquiries, reviewing job applications, securing the Site and understanding aggregate use. We rely on this basis only where your interests and rights do not override it.
- Legal obligation. We may process information where the law requires us to.
Where we rely on legitimate interests, you may object. Section 9 explains how.
How we share and disclose information
We share personal information only with the service providers that help us run the Site, and only as far as each needs it. Our providers are:
- Form and email provider. Form submissions are delivered to us by email through a third-party form and email service (for example, Formspree). This provider processes your submission so that it reaches us.
- Analytics provider. Plausible Analytics provides the aggregate, cookieless analytics described in section 6.
- Hosting and content-delivery provider. Our hosting and content-delivery network (CDN) provider hosts the Site on an enterprise edge network and keeps the technical logs described in section 2.4.
We require these providers to protect personal information and to use it only to provide their service to us. We may also disclose information where:
- the law requires it;
- we need to enforce our terms; or
- we need to protect the rights, safety or property of KernWerk Capital, our users or others.
If our business is reorganized, personal information may be transferred as part of that change, subject to this policy.
Cookies and tracking
The Site uses privacy-first, cookieless analytics provided by Plausible. Plausible does not set tracking cookies, does not collect personal data and does not follow you across other websites. Because the Site does not use tracking cookies, no cookie-consent banner is required.
The Site may use a small number of strictly necessary cookies or similar technologies if they are needed to make the Site work or to keep it secure. We do not use cookies for advertising or behavioral tracking.
Data retention
We keep personal information only as long as we need it for the purposes in this policy, and then we delete it or make it anonymous.
- We keep contact-form messages for [retention period, e.g. 24 months] after our last exchange with you, unless we need them longer to meet a legal obligation.
- We keep careers-form applications for [retention period, e.g. 12 months] after the application, unless you ask us to delete them sooner or the law requires us to keep them longer.
- Our provider keeps server and content-delivery logs for [log retention period, e.g. 30 days].
Aggregate analytics data holds no personal information, so we may keep it without a fixed limit.
Security
We take reasonable technical and organizational measures to protect personal information against loss, misuse and unauthorized access. These include encryption of the Site in transit, access controls and trusted service providers. No website or transmission over the internet is completely secure, so we cannot guarantee absolute security.
Your rights
Your rights depend on where you live. We honor the rights the law gives you, and we will not treat you unfairly for exercising them.
9.1 Rights under the GDPR (EEA and UK)
If you are in the European Economic Area or the United Kingdom, you have the right to:
- ask whether we hold personal information about you, and request a copy;
- ask us to correct information that is wrong or incomplete;
- ask us to delete your information;
- ask us to restrict how we use your information;
- object to our use of your information where we rely on legitimate interests;
- receive certain information in a portable, machine-readable form; and
- withdraw consent at any time, without affecting earlier processing.
You also have the right to complain to your local data-protection authority.
9.2 Rights under California law (CCPA and CPRA)
If you are a California resident, you have the right to:
- know what personal information we collect and how we use and disclose it;
- request a copy of the personal information we hold about you;
- ask us to correct inaccurate personal information;
- ask us to delete your personal information; and
- not be discriminated against for exercising these rights.
We do not sell or share personal information for cross-context behavioral advertising, so there is nothing for you to opt out of in that respect.
9.3 How to exercise your rights

International data transfers
KernWerk Capital is based in the United States, and our service providers may process information in the United States and other countries. If you contact us from the European Economic Area, the United Kingdom or elsewhere, your information will be transferred to and processed in the United States. The data-protection laws there may differ from those in your own country.
Where the law requires it, we rely on appropriate safeguards for these transfers, such as the European Commission's standard contractual clauses. You may ask us for more detail at [contact email].
Children's privacy
The Site is meant for business and professional audiences. The Site is not directed to children under 18, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, please contact us at [contact email] and we will delete it.
Third-party links
The Site may link to third-party websites, such as those mentioned in our Insights pages. We do not control those websites and are not responsible for their content or privacy practices. When you follow a link, please read the privacy policy of the website you visit.
Changes to this policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If the change is significant, we will give a more prominent notice. Please review this policy from time to time.
